OWI proof is more than a number, and sometimes includes several separate theories.
Indiana OWI cases may involve observed impairment, alcohol concentration, controlled substances, endangerment, prior history, or injury. Video, driving behavior, instructions, field-test conditions, timing, calibration, collection, and toxicology can affect the analysis.
A chemical result is evidence, not a substitute for reviewing how the sample was obtained, handled, tested, reported, and connected to the charged theory.

Implied consent can create a constrained and consequential decision.
A refusal finding can trigger a separate license suspension under current Indiana law, often one year, or two years with qualifying prior history. Police may also request judicial authorization for a test. Do not rely on this page to choose in a live stop; the facts and advisement matter immediately.
Counsel may examine reasonable grounds, the exact advisement, the request, refusal evidence, warrant process, timing, medical personnel, and BMV record.

Constructive possession and search authority are distinct questions.
The State may attempt to prove knowledge and control even where an item was not physically on the accused. The defense should separate whose space it was, who could access it, what conduct supports or undercuts knowledge, and what the search legally reached.
Changing hemp and marijuana policy elsewhere does not decide Indiana criminal liability or the constitutionality of a particular search. A trained officer’s claimed detection of marijuana odor may contribute to probable cause under current published Indiana authority, but training, place, timing, and the total circumstances still matter.

Not necessarily. Refusal may create license consequences, and police may seek a warrant or rely on another asserted basis. The particular advisement and procedure must be reviewed.
Can marijuana odor alone justify a search in Indiana?+
Search law is fact-specific and changes over time. Counsel should examine the claimed odor, surrounding facts, place searched, scope, and current controlling authority rather than assume a universal answer.
What if the drugs were not mine?+
Ownership is not the only issue. The State may allege constructive possession through knowledge and control. Shared access and the surrounding evidence can be important.
Will an OWI automatically cost me my license?+
License consequences depend on the test or refusal, procedural track, history, charge, and final result. Prompt review is important because some deadlines are separate from the criminal case.
